The Supreme Court has granted interim protection to gym owner Deepak Kumar, popularly referred to as “Mohammed Deepak”, by staying the criminal proceedings arising from his confrontation with members of the Bajrang Dal in Uttarakhand’s Kotdwar.
The matter stems from an incident in January 2026, when Deepak intervened after a group of Bajrang Dal members allegedly confronted an elderly Muslim shopkeeper over the use of the word “Baba” in the name of his establishment. A video of the confrontation subsequently went viral on social media, bringing Deepak into the national spotlight.
Following the incident, an FIR was registered against Deepak and his associate Vijay Rawat on allegations including voluntarily causing hurt, criminal intimidation, intentional insult and unlawful assembly under provisions of the Bharatiya Nyaya Sanhita. Deepak has maintained that the criminal case was retaliatory and that he had intervened to prevent the alleged harassment of the shopkeeper.
The controversy subsequently escalated when Bajrang Dal members gathered outside Deepak’s gym and residence in Kotdwar. Deepak had approached the Uttarakhand High Court seeking quashing of the FIR, along with directions for action against those allegedly responsible for hate speech and intimidation.
The High Court proceedings had also involved Deepak’s request for police protection and allegations of partisan conduct by police officials. The court, however, expressed reservations about the manner in which the reliefs were sought and directed the authorities to place on record the status of the investigations into the various FIRs arising from the episode.
The Supreme Court’s intervention now assumes significance as the criminal case against Deepak moves into a different judicial phase. The stay effectively puts the proceedings pursuant to the challenged FIR on hold pending further consideration by the apex court.
The episode has generated considerable public debate, touching upon questions of communal harmony, individual intervention in situations of alleged intimidation, police conduct and the contours of criminal liability arising from confrontations involving competing groups.
Deepak’s case had earlier attracted substantial public attention after the video of the January confrontation circulated widely online. His subsequent legal battle has kept the underlying dispute before the courts, with allegations and counter-allegations being examined through the criminal justice process.
The Supreme Court’s order will therefore be closely watched for its treatment of the FIR and the allegations levelled against Deepak, particularly as the case raises broader questions concerning the threshold for criminal prosecution arising out of a public confrontation and the exercise of individual intervention in a potentially volatile situation.
