The Delhi High Court has sought the response of the National Investigation Agency (NIA) on the possibility of granting conditional bail to jailed Baramulla MP Abdul Rashid Sheikh, popularly known as Engineer Rashid, in the alleged terror-funding case against him.
A Division Bench of Justice Prathiba M Singh and Justice Vikas Mahajan considered whether Rashid’s release could be balanced with stringent safeguards to address the concerns raised by the prosecution.
During the hearing, the Bench examined the possibility of imposing restrictions on Rashid’s movements as a condition of bail. One proposal under consideration was that he could be required to remain in Delhi and not travel to Jammu and Kashmir while the proceedings remain pending.
The Court’s deliberations assume significance given the nature of the allegations against Rashid and the objections raised by the investigating agency to his release. The Bench indicated that appropriate conditions could potentially be crafted to ensure that the concerns surrounding his release are adequately addressed without necessarily requiring his continued incarceration.
Rashid, an elected Member of Parliament from Baramulla, has been in custody in connection with an NIA investigation into alleged financing of terror-related activities. His bail plea has brought into focus the competing considerations of personal liberty, the seriousness of the allegations and the broader security concerns cited by the prosecution.
The High Court, however, has not passed any order granting bail. Instead, it has called upon the NIA to respond specifically to the possibility of releasing Rashid subject to stringent conditions.
The proposed restriction on his presence in Delhi could significantly limit his political and personal activities in Jammu and Kashmir while the criminal proceedings continue. Such a condition, if ultimately imposed, would seek to strike a judicial balance between safeguarding the investigation and upholding the accused’s right to liberty.
The proceedings are being closely watched as the case involves an elected legislator facing prosecution under stringent anti-terror laws. The High Court’s consideration of conditional bail reflects the broader judicial exercise of determining whether concerns relating to national security can be sufficiently addressed through enforceable restrictions rather than continued detention.
The NIA’s response is now expected to shape the next stage of the bail proceedings. The High Court will thereafter consider whether the proposed safeguards are adequate and whether Rashid can be released without compromising the interests of the prosecution or the ongoing proceedings.
