CJI Surya Kant declines Rahul Gandhi, Mallikarjun Kharge’s request for meeting over Electoral roll revision

Chief Justice of India Surya Kant has declined a request from Leader of the Opposition in the Lok Sabha Rahul Gandhi and Leader of the Opposition in the Rajya Sabha Mallikarjun Kharge for a meeting concerning the Election Commission of India’s Special Intensive Revision (SIR) of electoral rolls, observing that the issues involved are already pending consideration before the Supreme Court.

The request was reportedly made through email amid mounting opposition to the electoral roll revision exercise. The Chief Justice indicated that the concerns could be pursued through appropriate judicial proceedings, rather than through a separate meeting, given that the underlying dispute falls within the Court’s adjudicatory domain.

The development follows the Opposition’s announcement of a proposed march to the Supreme Court to submit a memorandum seeking the withdrawal of the SIR exercise and the resignation of Chief Election Commissioner Gyanesh Kumar. The proposed initiative seeks to bring the Opposition’s objections to the electoral roll revision process before the country’s highest judicial forum.

The Chief Justice’s response underscores the distinction between political representations made to a constitutional authority and the formal invocation of judicial remedies. Where a controversy is already seized of by a court, its resolution ordinarily proceeds through established procedures, including pleadings, submissions and judicial determination. An informal meeting does not constitute a substitute for adjudication or confer any predetermined outcome upon the issues in dispute.

The Opposition’s objections arise against the backdrop of continuing legal scrutiny of the Election Commission’s authority to undertake the SIR exercise. According to the report, the Supreme Court had previously upheld the Commission’s authority to conduct the revision in a ruling delivered in May 2026 by a Bench headed by Chief Justice Surya Kant. Separate proceedings concerning decisions attributed to the Chief Election Commissioner are also reportedly pending before the Court.

The controversy engages broader questions concerning electoral administration, the statutory powers of the Election Commission and the scope of judicial review over actions undertaken in the exercise of constitutional and statutory functions. The precise legal issues, however, must be assessed in light of the pleadings and judicial orders governing the respective proceedings.

The Chief Justice’s reported refusal to meet the Opposition leaders does not, in itself, constitute an adjudication on the merits of their objections to the SIR exercise. The substantive controversy remains distinct from the procedural question of how the grievances may be brought before the Court. Any challenge will have to be considered in accordance with the applicable legal framework and the submissions advanced by the parties.

The Supreme Court is reportedly scheduled to take up related proceedings on October 13, 2026. The hearing may provide a further opportunity for the issues concerning the electoral roll revision exercise to be addressed through the judicial process.
