The Delhi High Court has flagged an apparent fabrication of one of its judicial orders after finding that an additional paragraph stating “interim stay granted” appeared in a version of the order that was not part of the Court’s official record.
Justice Purushaindra Kumarav was hearing a petition filed by Meena Devi and another person alleging police inaction on their complaint concerning alleged fraud and forgery in an attempt to grab their property in Khera Khurd, Delhi.
During the hearing, counsel for the petitioners produced an order purportedly passed by the High Court on November 19, 2024. The Court examined its official record and found that the actual order recorded only that counsel for the respondents had sought time to obtain instructions. The matter was consequently listed for January 14, 2025, while the trial court record was also directed to be requisitioned.
However, the petitioners produced another version of the same order containing an additional paragraph which read: “Interim stay granted.”
The Court highlighted the discrepancy, noting that the order had been tampered with to falsely include a clause granting an interim stay. The Court held that the matter required investigation and appropriate action.
It accordingly granted liberty to the petitioners to approach the Registrar General with a detailed representation enclosing copies of both versions of the order. The Court directed that if such a complaint was filed, the matter should be taken to its logical conclusion.
The petitioners were also granted liberty to approach the Commissioner of Police with a detailed representation.
The Court directed the Commissioner of Police to inquire into all aspects of the alleged fabrication and take appropriate action in accordance with law within two months of receiving the representation.
The petition arose from the petitioners’ allegations of fraud and forgery relating to an attempt to usurp their property in Khera Khurd. Their grievance before the High Court concerned alleged police inaction on their complaint.
The apparent discrepancy in the November 19, 2024 order came to light during the proceedings when the petitioners relied upon a version containing the additional direction granting interim stay, which was absent from the Court’s official order.
