Supreme Court seeks inquiry report from Registry over procedural non-compliance

The Supreme Court on Monday expressed strong displeasure over the functioning of its Registry, flagging a serious procedural lapse in the implementation of a judicial direction.

The Bench of Chief Justice of India Surya Kant and Justice Joymalya Bagchi directed the Registrar (Judicial) to initiate a fact-finding inquiry into the discrepancy and place a report on record.

The Apex Court noted that, in an earlier order, it had expressly directed issuance of notice to the Enforcement Directorate (ED). However, the office report prepared by the Registry failed to reflect this direction and incorrectly recorded that no such order had been passed. The omission resulted in non-compliance with the Court’s directions, raising concerns over administrative diligence and procedural integrity.

Taking exception to the inconsistency between the judicial आदेश and the Registry’s record, the Bench underscored the binding nature of judicial directions and the obligation of the Registry to ensure strict adherence. The Court observed that such lapses undermined the due process of law and may impede the proper adjudication of matters.

In view of the apparent dereliction of duty, the Court has called for a detailed explanation from the Registrar (Judicial) regarding the failure to issue notice and the incorrect recording of the Court’s order. The inquiry is expected to examine the chain of administrative actions, identify accountability, and recommend corrective measures.
